周末本来决定给自己放个假，与朋友去爬山，可惜周五下午又来了稿件，是信息产业部关于《国家自主创新产品认定管理办法(试行)》。陶子于是又放弃了玩乐的时间，不过还好，翻译这类法规已经比较顺手，陶子只花了一个下午就搞定，然后再花了一个小时认真检查，陶子有时候比较粗心，所以检查是必须的，而且由于WORD的自动检查拼写功能出错了，只能自己一个一对着看。幸亏还有金山词霸的帮忙。在此不由得要感谢我们的金山词霸，真的伴随我走过了10个年头。是离不开的了。去年有个意大利语的朋友在做一个意汉的软件，需要志愿者将几百页的意汉大词典的条文一一输入，陶子强烈支持这类活动，花了一个星期的时间专门为他输入词条。想到以后这个软件成功后也有陶子一份功劳，就非常开心了。
通常情况的翻译稿，翻译是不能透漏给任何人的，但这种用来公布给大众的文件，陶子还是能够拿出来给朋友共享了。下周等陶子从杭州回来后，也正想把一些法律法规的资料整理下上传，以便更多的朋友参考。

国家自主创新产品认定管理办法(试行)
Accreditation and Management Measures (Trail ) on National Independent Innovation Products
为实施《国家中长期科学和技术发展规划纲要（2006-2020年）》（国发[2005]44号），营造激励自主创新的环境，努力建设创新型国家，根据《国务院关于印发实施<国家中长期科学和技术发展规划纲要（2006-2020年）>若干配套政策的通知》（国发[2006]6号），建立国家自主创新产品认定制度，规范自主创新产品认定工作，特制定本办法。
These measures are formulated in accordance with the <<Circular of the State Council on Implementing Several Supporting Policies for the Outline of the State Mid/Long-term Scientific and Technological Development (2006-2020) >>(Guo Fa [2006] No. 6.) for the purpose of implementing the requirements of the<< Outline of the State Mid/Long-term Scientific and Technological Development (2006-2020)>> (Guo Fa [2005] No. 44), creating the circumstance of spiriting up independent innovation and endeavoring to set up innovation-type state to constitute and regulate national accreditation system of independent innovation product.
第一条 科学技术部（以下简称科技部）会同国家发展和改革委员会（以下简称国家发展改革委）和财政部对国家自主创新产品进行认定，负责国家自主创新产品认定工作的管理和监督、制定相关制度与标准、编制《国家自主创新产品申报说明》、组织开展产品认定工作并公布《国家自主创新产品目录》（以下简称《产品目录》）。
Article One: Ministry of Science and Technology (hereafter referred to as MOST ), along with National Development and Reform Commission (hereafter referred to as SDPC) and Ministry of Finance (hereafter referred as to MOF) carry out the accreditation of National Independent Innovation Products, take charge of the management and supervision of this task, constitute related systems and standards, work out Declaration Instructions of National Independent Innovation Products, organize the accreditation task and promulgate<< Product Catalogue of National Independent Innovation Products>> (hereafter referred to as <<Product Catalogue>>).
第二条 国家自主创新产品认定工作遵循公开、公正、公平、科学的原则。经认定的国家自主创新产品将在政府采购、国家重大工程采购等财政性资金采购中优先购买，并在高新技术企业认定、促进科技成果转化和相关产业化政策中给予重点支持，以引导全社会支持自主创新产品的发展。
Article Two: The Accreditation of National Independent Innovation Products shall keep to the principles of openness,justness,fairness and science. Accredited National Independent Innovation Products will enjoy the preference right in the Financial Fund’s Procurement such as Government Purchase, major National Project Procurement and receive key support in the High-tech Enterprise Identification, Promoting Transformation of Scientific and Technological Achievements and related industrialization policies in order to lead the whole society to support the development of independent innovation products
第三条 自主创新产品认定工作遵循自愿申请的原则。凡在中国境内具有中国法人资格的企业、事业单位均可申请认定。
Article Three: Accreditation of Independent Innovation Products shall keep to the principles of free will application. Every enterprise and pubilic service unit with Chinese legal personality within Chinese territory are able to apply for this accreditation.
第四条 申请认定的国家自主创新产品，应符合以下条件：
Article Four: Who applies for accreditation of the National Independent Innovation Products shall accord with the following terms and conditions:
（一）产品符合国家法律法规，符合国家产业技术政策和其他相关产业政策。
I. Products shall be accordance with China’s laws and regulations, national industrial technology policy and other related industrial policies.
（二）产品具有自主知识产权，且权益状况明确。产品具有自主知识产权是指，申请单位经过其主导的技术创新活动，在我国依法拥有知识产权的所有权，或依法通过受让取得的中国企业、事业单位或公民在我国依法拥有知识产权的所有权或使用权。
II. Products possess independent intellectual property rights and tangible rights and interests. Products with independent intellectual property rights means that applying units possess the proprietary of intellectual property rights in accordance with law in China through its leading technical innovation activities, or Chinese enterprises, pubilic service units or citizens, by means of assignment in accordance with law in China, have the proprietary and access of the intellectual property rights.
（三）产品具有自主品牌，即申请单位拥有该产品注册商标的所有权。
III. Products prossess independent brand names, namely the applying units possess the proprietary of the registered trade marks of products.
（四）产品创新程度高。掌握产品生产的核心技术和关键工艺；或应用新技术 原理、新设计构思，在结构、材质、工艺等方面对原有产品有根本性改进，显著提高了产品性能；或在国内外率先提出技术标准。
IV. Products possess state-of-the-art innovation. Applying units predominate the core technology and key techniques of the manufacture of the products, or apply new technological theory, new design conceptive to make an essential changes in the structure, raw material and arts and crafts and remarkably improve the performance, or take the lead in presenting standard at home and abroad.
（五）产品技术先进，在同类产品中处于国际领先水平。
V. Products with advanced technology and at international leading level in the same products of the kind.
（六）产品质量可靠，通过国家认证认可监督管理委员会或各省、自治区、直辖市质量技术监督部门资质认定的实验室和检查机构的检测。属于国家有特殊行业管理要求的产品（如：医药、医疗器械、农药、计量器具、压力容器、邮电通信等产品），必须具有国务院相关行业主管部门批准颁发的产品生产许可；属于国家实施强制性产品认证的产品，必须通过强制性产品认证。
VI. Product quality is reliable and pass the examination and measure of Certification and Accreditation Administration of the People’s Republic of China (CNCA) or the laboratories and censorates authorized by departments of quality and technology supervision in each province, autonomous region and municipality directly under the central government. Products under administrative requirement of the special industries ( for instance: drugs and medicines, medical equipments, pesticides,measuring instruments, pressure vessels and post and telecommnications and so on ) shall possess the production license issued by administration department of the State Council. Products that the state implements compulsory product accreditation must pass it and get China Compulsory Certification (CCC)
（七）产品具有潜在的经济效益和较大的市场前景或能替代进口。
VII. Products shall have potential economic benefits and wide market prospect or can substitute imported merchandise
第五条 申请单位须根据《国家自主创新产品申报说明》向省、自治区、直辖市、计划单列市科技厅（委、局）提出申请，并提交以下申报材料：
Article Five: Applying units shall present the applicaton with Scientific and Technological Bureaus of the provinces,autonomous regions, municipalites directly under the center government, and municipalities separately listed on the State plan, according to <<Declaration Instruction of National Independent Innovation Products>> and submit the following declaration documents
（一）统一的申报表格。
I. Uniform Declaration Form
（二）单位的法人营业执照副本或复印件，若属中外合资，应提供在工商管理部门注册登记的股权结构。
II. Duplicates or copies of the Business License of the legal person of the unit. For Sino-foreign joint ventures, equity structures regirstered in Industrial and Commercial Administration departments also shall be provided
（三）关于产品知识产权权益状况和品牌状况的有效证明文件。涉及多个单位的，应提交与产品技术归属及权限有关的技术转让、许可、授权、合作生产、合作开发的合同或协议。
III. Valid documents about rights and interests of product intellectual property rights and brand name status. If more units are involved, the contract or agreement of technology assignment, license,authorization, cooperative production and development related to product techique ascription or purview shall be submitted.
（四）产品检测报告，或特殊行业产品生产许可证、强制性产品认证证书。
IV. Product inspection report, or production license for special industry, compulsory product certificate.
（五）产品采用标准证明。
V. Standard Certifcate applied by products
（六）其他需提供的材料，包括环保达标证明及产品创新程度与生产规模等方面的有效证明。
VI. Other documents including enviornmental protection solution certificate and other valid certificates about the scale of product innovation and production.
第六条 各省、自治区、直辖市、计划单列市科技厅（委、局）会同本级经（贸）委（发展改革委）、财政厅（局）等根据《国家自主创新产品申报说明》规定的条件和要求，对本地区的申报产品进行汇总和初步审查，并组织专家评审。对符合条件的产品择优向科技部推荐，提交推荐产品的推荐意见及产品申报材料。《国家自主创新产品申报说明》及产品认定标准和具体认定程序将另行制定。
Article Six: Scientific and technological bureaus of the provinces,autonomous regions, municipalites directly under the center government, and municipalities separately listed on the State plan, along with Economic and Trade Commission of the same grade (SDPS) and Provincial Finance Bureau, collect and make a primary examination of the declaration products in its own district, organize specialists to evaluate and appraise, based on the conditions and requirements stipulated on <<Declaration Instructions of National Independent Products>>. They also shall select the better qualified products and recommend to the MOST and submit the recommending opinions and the declaration documents. <<Declaration Instruction of National Independent Innovation Products>> , the product accreditation standard and specific accreditation procedures shall be additionally set up.
第七条 科技部会同国家发展改革委、财政部 委托相关机构，按照统一的认定条件具体承担自主创新产品认定评价工作。
Article Seven: MOST, along with SDPC and MOF will entrust authorized institution to undertake the accreditation and evaluation of the independent innovation products according to the uniform accreditation qualification.
（一）承担自主创新产品认定工作的机构和人员（以下简称认定机构）必须符合《科技评估管理暂行办法》对相关机构和人员的要求，具备承担自主创新产品认定工作的能力和条件。
I. Organizations and personnel that undertake the accreditation of independent innovation products (hereafter referred as accreditation organization) shall accord with the requirements for related organizations and personnels stipulated in the<< Provisional Measures for Administration of Science and Technology Evaluation>> and possess the capability and qualification to undertake the accreditation of independent innovation product.
（二）认定机构应组织产品相关领域的研究开发、生产、知识产权、管理、认定评价等方面的专业人员对产品申报材料进行审查与评价，必要时可进行现场考察或要求申请单位进行陈述和答辩。
II. Accreditation organization shall organize the professionalsl in the related fields of R& D, production, intellectual property rights,manaement, accreditation and appraisal to examine and evaluate the product self-declaration documents. If necessary, an investigation on site or a request of presentation and representation for the applying units shall be launched
（三）认定机构出具产品认定报告对其报告负责，必须依法保守认定产品的技术秘密，不得非法占有申请单位的科技成果，不得从事认定工作范围内的产品研究开发或生产工作。
III. Accreditation organization issues the accreditation report and is responsible for it. It shall keep the technical secretes of the accredited products in accordance with related laws and shall not accroach the scientifical achievements of applying units, nor undertake any research and development or production in the same field of accreditation
第八条 科技部对认定评价结果进行审定，形成《产品目录》初步意见，并向社会公示。公示无 异议的，科技部会同国家发展改革委、财政部形成正式《产品目录》，颁发国家自主创新产品认定证书。
Article Eight: MOST shall examine and approve the results of the accreditation and evaluation to compile a primary opinion of <<Product Catalogue >>and publicize in society. If there is no any dissidence after the publication, MOST, along with SDPC and MOF , form an official <<Product Catalogue >>and promulgate the Accreditation Certificate of National Independent Innovation Product
第九条 科技部在其官方网站和《科技日报》上向社会公布《产品目录》。《产品目录》主要包括产品名称、型号、主要性能与配置、有效期、单位名称等内容。
Article Nine: MOST will publicize the<< Product Catalogue>> on its official website and << S.T.News>>.<< Product Catalogue>> mostly shall include the product name, model, key performance and configuration, period of validity, unit name and etc.
第十条 认定证书有效期根据产品的不同特点分为两年、三年或四年。有效期满，被授予单位可再次申请认定，但应在有效期截止前三个月提出。
有效期内，若产品状况发生变化，被授予单位应及时向科技部报告。对不再符合认定条件的产品，将取消其国家自主创新产品资格，并收回认定证书。
Article Ten: The term of the validtiy for the accreditation certifcate shall be divided into two-year, three-year and four-year according to the different features of the products. The authorized unit is able to apply for the accreditation again after the expiry of the validity period but the application shall be represented three months on and before the expiry. The authorized unit shall report to MOST in time if there is any changes in the product within the period of validity. Products that do not accord with the accreditation qualification will lost the title of National Independent Innovatation Products and the accreditation cerficate shall also be taken back.
第十一条 产品认定结果及参与产品认定工作的相关部门和机构接受全社会监督。对于有异议的产品，任何单位和个人可向科技部申述，科技部根据情况进行调查或组织复议，并反馈调查结果。
Article Eleven: The accreditation results and the authorized departments and organizations concerned with the accreditation shall be supervised by whole society. Any unit and individual is entitled to represent with MOST on any controversial product and MOST shall investigate or organize administrative reconsideration and feedback the results
第十二条 科技部对申请单位和认定机构进行信用记录和监督管理。
Article Twelve: MOST shall keep records of , supervise and manage the credit standing of the applying units and accreditation organizations
（一）申请单位提交的各种材料应真实可靠。对于弄虚作假或采取不正当手段骗取认定证书的单位，将取消国家自主创新产品资格和认定证书、取消一定时期内申报自主创新产品的资格。
I. All kinds of documents submitted by applying unites must be real and reliable. For units who falsify or take unfair method to defraud the accreditation certificate, MOST will cancel the qualification of National Independent Innovation Products and accreditation certification and abrogate the qualification to apply for the declaration of independent innovation products within a certain period of time.
（二）认定机构如泄漏认定产品的技术秘密、非法占有申请单位的科技成果、从事认定工作范围内的产品研发或生产、认定工作中弄虚作假、出现重大错误且造成严重 影响，将其取消其认定资格；造成损失的，责令其赔偿损失；构成犯罪的，依法移送司法机关追究法律责任。
II. The accreditation qualification shall be cancelled if the accreditation organization discloses the technical secrets of the accredited products, accroaches the scientifical achivements of the applying units, undertakes the research and development or poduction of the product within the scope of the accreditation, falsifies in the procedure of accreditation, makes gross errors and cause serious impact. In case of any loss and damages,compensation shall be made in light of loss of property. In case that a crime is constituted, suspected of being involved will be transferred in accordance with the law to the judicial authority and investigated and affixed the related legal responsibility.
（三）管理部门如泄漏认定产品的技术秘密、认定工作出现重大错误或以权谋私，将对有关人员进行处罚；构成犯罪的，依法移送司法机关追究法律责任。
III. People involved shall be punished when administrative departments disclose the technical secrets of the accredited products, gross errors or seek private gains through power. In case that a crime is constituted, suspected of being involved will be transferred in accordance with the law to the judicial authority and investigated and affixed the related legal responsibility.
第十三条 军事装备自主创新产品认定办法由有关部门另行制定。
Article Thirteen: Accreditation measures on independent innovatation products of military equipment shall be separately promulgated by authorized departments
第十四条 本办法由科技部、国家发展改革委、财政部负责解释。 本办法自发布之日起施行。
Article Fourteen: MOST, SDPC and MOFshall be responsible for the interpretation of these measures.
These measures shall go into effect as of the date of its promulgation.
